1.3 "Service": Tongue analysis and TCM assessment service provided by the Application

1.4 "Credit": Virtual currency used to perform analyses

1.5 "Content": Photos and information uploaded by the User

2. SERVICE DESCRIPTION

2.1 Application Purpose

TCM Tongue Analysis is an educational and informational application that performs tongue analysis based on Traditional Chinese Medicine (TCM) principles.

2.2 Service Scope

• Tongue photo analysis
• TCM assessment and recommendations
• Analysis history storage
• Personalized health recommendations

2.3 Service Limitations

The Application DOES NOT provide:

• Medical diagnosis
• Treatment recommendations
• Professional medical consultation
• Emergency health services
• Prescription medications

3. USER ACCOUNT

3.1 Account Creation

• You must sign in with Google Authentication
• You must be 13 years of age or older
• You must provide accurate and current information
• You must keep your account information confidential

3.2 Account Security

• You are responsible for your account security
• You must report unauthorized access immediately
• You may not share your account with others

3.3 Account Suspension/Deletion

We may suspend or delete your account in the following cases:

• Violation of terms of use
• Illegal activities
• Providing false information
• System abuse

4. CREDIT SYSTEM AND PURCHASES

4.1 Credit Usage

• Each analysis consumes 9 credits
• Credits are non-refundable
• Unused credits do not expire
• Credits are lost when account is deleted

4.2 Purchase Transactions

• In-app purchases are made through Apple App Store and Google Play Store
• Prices are displayed in your local currency
• Purchase transactions are subject to the respective store's terms
• Transaction security is provided through RevenueCat

4.3 Refund Policy

• Credits are non-refundable as they are digital products
• Contact our support team for technical issues
• Refund requests are evaluated according to Apple/Google policies

4.4 Price Changes

• We reserve the right to change credit package prices
• Price changes do not affect previously purchased credits

5. USER RESPONSIBILITIES

5.1 Content Upload

As a user:

• You may only upload your own tongue photos
• You may not upload others' photos without permission
• You may not upload inappropriate, obscene, or illegal content
• You may not upload content that infringes copyright

5.2 Prohibited Uses

You may not use the Application for:

• Illegal activities
• Violating others' rights
• Hacking or reverse engineering the system
• Distributing spam or malware
• Using automated bots or scripts
• Unauthorized commercial use

5.3 Providing Accurate Information

• You must provide accurate personal information (age, weight, height) for analysis
• Incorrect information may affect analysis results
• You must fully describe your health complaints

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Application Ownership

• The Application and all its content are our property
• Design, logo, code, and algorithms are protected by copyright
• Trademark and patent rights are reserved

6.2 User Content

• Photos you upload belong to you
• You grant us the right to process them for analysis
• You always retain the right to delete your content

6.3 License

We grant you a limited, personal, non-transferable license to:

• Download the Application for personal use
• Use our services
• View your analysis results

7. HEALTH WARNING AND DISCLAIMER

7.2 Analysis Results

• AI-assisted assessment
• No guarantee of 100% accuracy
• Based on Traditional Chinese Medicine principles
• Not evaluated according to scientific medical standards

7.3 Usage Risk

By using the Application, you:

• Acknowledge that results are not definitive
• Declare that you use it at your own responsibility
• Commit to seeking professional help for medical decisions

8. LIMITATION OF LIABILITY

8.1 Disclaimer of Warranties

The Application is provided "AS IS". We do not guarantee:

• Uninterrupted service
• Error-free operation
• Achieving specific results
• Absence of security vulnerabilities

8.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect damages
• We are not liable for data loss
• We are not liable for issues arising from third-party services
• Our maximum liability is limited to the amount you paid in the last 12 months

8.3 Service Interruptions

Service interruptions may occur due to:

• Maintenance and updates
• Technical failures
• Third-party service interruptions (Firebase, OpenAI)
• Force majeure

9. THIRD-PARTY SERVICES

9.1 Integrations

The Application uses the following third-party services:

• Google Authentication (Identity verification)
• Firebase (Database and storage)
• OpenAI (AI analysis)
• RevenueCat (Purchase management)
• Apple App Store / Google Play Store

9.2 Third-Party Terms

• These services have their own terms of use
• We are not responsible for third-party service policies
• We may change integrations without prior notice

10. PRIVACY AND DATA PROTECTION

10.1 Privacy Policy

• Data collection and use are explained in detail
• Compliant with GDPR and data protection laws

• We cannot guarantee 100% security

11. CHANGES TO TERMS OF USE

12. SERVICE TERMINATION

• Deletion is irreversible
• Unused credits are not refunded

We may terminate your account in the following cases:

• Illegal activities
• System abuse
• Long-term inactive account

12.3 Service Discontinuation

• We reserve the right to completely shut down the Application
• We will provide 30 days' notice
• No refunds for unused credits

13. DISPUTE RESOLUTION

13.1 Governing Law

• These terms are subject to the laws of the Republic of Turkey
• Turkish courts have jurisdiction

13.2 Dispute Process

2. Allow 30 days for amicable resolution
3. If no resolution is found, you may pursue legal remedies

13.3 Arbitration

• Disputes will first be attempted to be resolved through mediation
• Arbitration will take place in Istanbul

14. GENERAL PROVISIONS

14.1 Entire Agreement

• These terms constitute the entire agreement between the parties
• They supersede all prior oral or written agreements

By using this Application, you:
